Privacy Policy — Embryly

The short version: We collect only what we need to run Embryly — your account details, the food photos and barcodes you scan, and the pregnancy information you choose to share. We use AI providers to analyze your scans, we never sell your personal information, and you can delete your data at any time.

1. Who we are

Embryly is operated by Benekan Technologies LLC ("Embryly," "we," "us," or "our"). This Privacy Policy explains what information we collect through the Embryly mobile application and website (the "Service"), how we use and share it, and the choices you have. By using the Service, you agree to the practices described here.

2. Information we collect

Information you provide

Account information: name, email address, and password when you create an account.
Pregnancy and health-related information: details you choose to share, such as your due date or pregnancy week, dietary preferences and restrictions, weight entries, and foods you log. This may be considered sensitive health-related information, and by providing it you consent to our processing of it as described in this Policy.
Photos and scans: food photos you take or upload and barcodes you scan, which are processed to identify foods and generate insights.
Communications: messages you send us, such as support requests or feedback.

Information collected automatically

Device and usage data: device type, operating system, app version, language, general region, crash logs, and how you interact with features.
Camera access: the app requests camera permission to scan barcodes and photograph food. We access your camera only when you actively use these features, and you can revoke permission in your device settings.

We do not collect precise location data, and we do not access your contacts or photo library beyond images you deliberately submit.

3. How we use your information

To provide the Service: identify scanned foods, generate AI nutrition insights, and power your tracking features;
To personalize guidance based on your pregnancy stage and preferences;
To maintain, secure, and improve the Service, including debugging and analytics;
To communicate with you about your account, support requests, and important updates;
To comply with legal obligations and enforce our Terms of Use.

4. AI processing of your scans

When you scan a barcode or photograph a food, that image or code — along with relevant context such as your pregnancy week — may be transmitted to and processed by third-party AI service providers acting on our behalf to identify the food and generate an assessment. These providers are contractually restricted to processing your data only to provide services to us. AI-generated outputs are informational only and may be inaccurate; see our Terms of Use for the full disclaimer.

5. How we share information

We do not sell your personal information, and we do not share it with third parties for their own advertising. We share information only:

With service providers that help us operate the Service (cloud hosting, AI processing, analytics, crash reporting, email delivery), under contracts limiting their use of your data;
For legal reasons, if required by law, subpoena, or legal process, or to protect the rights, safety, or property of our users, the public, or Embryly;
In a business transfer, such as a merger, acquisition, or sale of assets, in which case this Policy will continue to apply to your data or you will be notified of changes;
With your consent, for anything else.

We may use aggregated or de-identified data — which cannot reasonably be used to identify you — for analytics, research, and improving the Service.

6. Data retention

We keep your personal information for as long as your account is active or as needed to provide the Service. When you delete your account, we delete or de-identify your personal information within a reasonable period, except where we must retain it to comply with legal obligations, resolve disputes, or enforce agreements. Scanned images are retained only as long as needed to provide and improve the scanning feature.

7. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect your information, including encryption in transit. However, no system is completely secure, and we cannot guarantee absolute security. Please use a strong, unique password and keep it confidential.

8. Your rights and choices

Depending on where you live, you may have the right to:

Access the personal information we hold about you;
Correct inaccurate information;
Delete your account and personal information;
Export your data in a portable format;
Withdraw consent to processing that relies on consent, such as health-related data;
Object to or restrict certain processing.

You can exercise most of these directly in the app (Profile → Settings), or by emailing info@benekan.com. We will respond within the timeframe required by applicable law and will not discriminate against you for exercising your rights. If you are in the EU/EEA or UK, you also have the right to lodge a complaint with your data protection authority; if you are a California resident, these rights are provided consistent with the CCPA/CPRA.

9. Children's privacy

The Service is intended for adults and is not directed to anyone under 18. We do not knowingly collect personal information from children. If you believe a child has provided us personal information, contact us at info@benekan.com and we will delete it.

10. International users

We are based in the United States, and your information is processed and stored in the United States and other countries where our service providers operate. These countries may have data protection laws different from those in your country. Where required, we use appropriate safeguards for international transfers.

11. Do Not Track

Some browsers offer a "Do Not Track" signal. Because there is no common standard, the Service does not currently respond to these signals.

12. Changes to this Policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you through the Service or by email before they take effect. The "Effective date" above reflects the latest revision, and your continued use of the Service after changes take effect constitutes acceptance.
